Hi,

I am a MB, not BMW owner. But, I would like to let you know what happened to me and be aware of it. I hope it will not happen to you.

Here is my story.

Three months ago, I found the company, Virtual Junkyard, in Texas selling used body kit, headlight, taillight... I contacted David Munoz, the sales, and to order a 99 AMG front bumper for E-class. He asked me to send them a check as payment. I thought it is OK, because it is a company at that time....

I sent them the check on 2/5/05, and received a bumper on 2/20/05. But, it is a CLK W208 AMG bumper, NOT for E-class. I contacted David again. He promised me I will get the right bumper "next" week. However, nothing!!! I tried to call him many times, almost everyday after a week. He rarely answers my phone call. When he accidently answers, he always tell me, "let me check out what is going on, and call me 30 minutes later", and hangs up rapidly. Of course, he would not answer my phone again. I also write him email, the same thing, no response. I just keep calling and leaving message...

Now, my money is gone, and I got a CLK bumper occupying space....

My friend told me, I can't do anything with it. First, I can't sue them from California. Second, it is not fraud, because they did send me a bumper, just wrong. I felt so frustrated about it. If anyone knows what I can do, please advice me. Also, if anyone looks for bumper, headlight... whatever, be careful with them.

The following is their information I found:

Sorry to hear, I know the BBB cannot enforce any results, but making a file with them will definately be a good start. www.bbbhou.org

Here are some other sites you might want to consider posting in.

Make sure you block your caller ID from your phone or use different phones to try to call him. He can’t not answer his phone all of the time if he is running a business – legit or not.

I got the same problem

Unfortunatelly, I did not get this warnning earlier.
I don't know if they are the same guy. But my guy is Jayson (the second address from the original message)
I just order the rear bumper for my CLK las week. He told me that he would send it out right after he get my check. Guess what? I called him and he told me that since the stuff I ordered is over size. He cannot drop it off ad Fedex and have to wait untill last friday (about 05/20/05) in order for the truck to come to pick it up.
It was ok for me even though I was in rush waiting for it. He told me he should have it ready until monday.
Monday came. I call him and he said that sent him an email at vjyshipping@yahoo.com in order for him to send me the tracking.
Tuesday, Nothing happens. I call him and he put me on hold then click (hang up) ???? :(
Sending email, calling many times, no response.
What should I do?
I will try to do anything in order to get this problem straight.

Sign up the e-mail for porn. Post his phone number on various message boards and get people to set autodialers to that phone number. Sign up the address too for junkmail for that matter. [hihi]

Really bad Benz,

I received the parts yesterday. I had ordered rear bumper + re-enforcement + 2 (left/right) tail lights for my 99 Mercedes CLK.
Guess what he sent me????

94 - rear bumper C class
2 driverside tail light of (one is E class, one is C class, I guess)
NO RE-ENFORCEMENT at all

How bad!!!! Upset.... bissssssss.......

I sent him an email and called him aready, no answer. I will send these items back to him and do any effort to get my money back!
Does any one have any idea where I should go to sue, compain, or do any further action to again this guy?
Please help!
I intend to pump him emails, phone call all day/night long.
If you want to do the same let me know Benz.
I know for sure there are not only you and me Benz. People on net will have the same problem with this guy.
That's fraud, because he took our money and just give our whatever part he has which is not what we order. That's also considered FRAUD.
PLEASE DO ACTION to take back our right!!!!

I am really sorry for you, too!

I just called him with my friend's phone with different area code.
He picked up the phone and told me I have to contact his manager, Mark.
Then, he gave me the office number, 713-270-0424, guess what?
The fax machine answered me, bi-bi-bi-....

My friend told me, I can't sue him from California.
But, I can go to Texas, if I win, he has to pay me everything.
However, how do I have time to do that?
I don't know what I can do....

Any idea?

If you find more defrauded customers, you can start a class action law suit.
I know another person in WA, he ordered bumper for W211, but got W208, too.
Three, is that enough?

Call an attorney in Texas and tell him your storie(s), make sure you hook him up with all three "victims" and ask him if he will represent you guys either pro-bono or if he is willing to accept a fee only if he recovers. Who knows he may know others in Texas who have been defrauded.
